1. Agreement to Terms

By accessing or using PioneerFix's website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. Services

PioneerFix provides home repair and maintenance services including, but not limited to:

  • HVAC installation, repair, and maintenance
  • Plumbing services
  • Electrical services
  • General home repairs
  • Emergency services
  • Preventative maintenance programs

3. Account Registration and Security

3.1 Account Creation

To use certain features of our Services, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept all responsibility for activities under your account
  • Notify us immediately of any unauthorized use

3.2 Account Types

We offer different account types including Customer, Technician, Property Owner, and Tenant accounts. Each account type has specific features and responsibilities as outlined in our platform.

4. Service Requests and Quotes

4.1 Quote Requests

When you submit a quote request, we will provide an estimate for the requested services. Quotes are valid for 14 days unless otherwise specified. Final pricing may vary based on actual work required.

4.2 Service Scheduling

Once you approve a quote, we will schedule a service appointment. You must provide reasonable access to the property and ensure a responsible adult (18+) is present during service.

4.3 Cancellations and Rescheduling

  • Cancellations made 24+ hours in advance: No charge
  • Cancellations made less than 24 hours: May incur a cancellation fee
  • No-shows or denied access: Full service call charge may apply
  • We reserve the right to cancel or reschedule due to weather or emergencies

5. Payment Terms

5.1 Pricing and Fees

All prices are in USD and subject to applicable taxes. We accept payment via:

  • Credit/debit cards (Visa, Mastercard, American Express, Discover)
  • Digital wallets (Apple Pay, Google Pay)
  • ACH bank transfers (for subscription services)

5.2 Payment Processing

All payments are processed securely through Stripe. We do not store your complete payment card information on our servers.

5.3 Subscription Services

For maintenance plans and subscription services:

  • Subscriptions renew automatically until canceled
  • You will be charged on the same day each billing period
  • Cancel anytime through your account dashboard
  • Cancellations take effect at the end of the current billing period
  • No refunds for partial periods

5.4 Late Payments

Invoices are due upon receipt unless otherwise agreed. Late payments may incur a 1.5% monthly finance charge and may result in service suspension.

6. SMS/Text Message Communications

SMS Terms:

  • By providing your mobile number, you consent to receive SMS notifications
  • Message frequency varies based on your service activity
  • Standard message and data rates may apply
  • Consent to receive SMS is not a condition of purchase or service
  • You can opt out anytime by replying STOP to any message
  • Reply HELP for assistance or contact support
  • Supported carriers: All major US carriers
  • We send notifications for: appointments, quotes, technician updates, payments, emergencies

7. Warranties and Guarantees

7.1 Workmanship Warranty

We guarantee our workmanship for 90 days from service completion. If you experience issues related to our work within this period, we will return to correct it at no additional charge.

7.2 Parts Warranty

Parts and equipment are covered by manufacturer warranties. We will assist with warranty claims but are not responsible for manufacturer defects.

7.3 Limitations

Warranties do not cover damage caused by: misuse, negligence, accidents, natural disasters, unauthorized repairs, or normal wear and tear.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our liability is limited to the amount paid for the specific service
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for pre-existing conditions or damage
  • We maintain appropriate insurance coverage
  • You must report damage claims within 48 hours of service

9. Property Access and Safety

You agree to:

  • Provide safe access to work areas
  • Secure pets during service
  • Disclose known hazards (asbestos, mold, etc.)
  • Clear work areas of valuable items
  • Ensure adequate lighting and access to utilities

10. Emergency Services

Emergency services are available 24/7 and carry premium pricing. We will provide pricing information before beginning work when possible. True emergencies may require immediate action to prevent property damage or safety hazards.

11. Intellectual Property

All content on our Services, including text, graphics, logos, and software, is the property of PioneerFix or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Prohibited Conduct

You agree not to:

  • Violate any laws or regulations
  • Harass, threaten, or abuse our staff or technicians
  • Provide false or misleading information
  • Attempt to hack, interfere with, or damage our Services
  • Use our Services for any unlawful purpose
  • Impersonate others or misrepresent your affiliation

13. Privacy

Your use of our Services is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your information.

14. Termination

We reserve the right to suspend or terminate your account and access to our Services at our discretion, without notice, for conduct that violates these Terms or is harmful to other users, us, or third parties, or for any other reason.

15. Dispute Resolution

15.1 Informal Resolution

If you have a dispute, please contact us first to attempt an informal resolution.

15.2 Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles.

15.3 Jurisdiction

Any legal action related to these Terms must be brought in the state or federal courts located in Harrisburg, Pennsylvania.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our Services after changes constitutes acceptance of the updated Terms.

17. Severability and Waiver

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not constitute a waiver of such right or provision.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PioneerFix regarding your use of our Services.
